Planning and Approval

THE PLANNING AND APPROVAL PROCESS

The Kyoto Energy Park project application has been assessed in accordance with Part 3A of the Environmental Planning and Assessment Act 1979. The NSW Department of Planning (DoP) is responsible for the passage of the development application and have now made an informed decision following a detailed assessment of the project.


 

During assessment of the application under the Part 3A the following steps were required:

  • Commencement of the Part 3A process by lodging a Project Application for project approval and a preliminary environmental assessment with the Director General of the DoP.
  • After the project application is submitted the Director-General consults various public agencies and government departments before providing the proponent with a list of requirements for the environmental assessment.
  • The proponent then undertakes the assessment in accordance with these Director General's requirements and submits the assessment to the Director-General of the DoP for consideration.
  • The Director General will then consider the adequacy of the environmental assessment and may request additional information or a revised assessment.
  • After it is accepted by the Director-General, the environmental assessment will be publically displayed for at least 30 days and written submissions may be made by any person within that time.
  • At the end of the display, the Director General may ask the proponent to respond to the issues raised and may modify the proposal to minimise impacts on the environment.
  • If the proponent significantly changes the proposal in response to the issues raised, a preferred project report describing the revised project may need to be prepared.
  • The Director-General then consults with agencies and government departments and provides an assessment report for consideration by the Minister for Planning.
  • The Minister for Planning decides whether to approve the proposal, with or without conditions.
